Legislation for inter-country adoption in France
I. INTERNATIONAL ADOPTION PROCESS IN FRANCE
REQUIREMENTS TO THE PROSPECTIVE ADOPTIVE PARENTS
- Adoptive parents can be a married couple with marriage more than two years who live together according to Art. 343 Regulation №96-604
- Each one of the married couple must exceed 28 years old;
- Adoptive parent can be single adoptive parent at minimal age of 28 years;
- Adoptive parent must be at least 15 years older than the adopted child;
- No one can be adopted from more persons except if they are married. Apart from that, new adoption can be done after the adoptive parent’s death or the death of both of the adoptive parents or after the adoptive parent’s death when the new husband/ wife submits an application for adoption Art.356 Civil Code of France;
- French citizen can adopt children under 15 years old.
II. INTERNATIONAL ACTS AND REGULATION OF ITALY
INTERNATIONAL ACTS
The international acts that regulate the international adoptions in which France is a side are:
- Convention on children protection and cooperation in the field of inter-country adoption on 29 May, 1993. On 5 April 1995 France signed the Hague convention and ratified it on 30 June, 1998. The Hague Convention entered into force on 1 October, 1998;
- Convention on the rights of the child of 20 November, 1989.
